General Terms and Conditions (GTC) of Wave-Lovers

§ 1 Scope of Application and Role of Wave-Lovers

(1) These General Terms and Conditions (GTC) apply to all orders placed via the online marketplace “Wave-Lovers” (www.wave-lovers.com).

(2) Wave-Lovers acts as a central platform for ordering, payment, and customer communication. Wave-Lovers acts exclusively as a mediator between customers and the respective manufacturers/dealers (hereinafter referred to as “Seller”).

(3) Wave-Lovers is at no time the seller of the products offered.

§ 2 Contracting Parties and Support Promise

(1) The purchase agreement is concluded exclusively between the customer and the respective Seller. The legal responsibility for delivery, warranty, and contract fulfillment lies with the Seller.

(2) Wave-Lovers is your central point of contact. We actively support you with questions regarding delivery status, delays, or transport damage and coordinate communication with the Seller.

§ 3 Conclusion of Contract and Reservation of Correction

(1) The presentation of products does not constitute a legally binding offer. A purchase agreement is only concluded when the order is accepted by Wave-Lovers on behalf of the Seller within 24 hours (on business days).

(2) Should price information or shipping costs be incorrect due to errors or extraordinary geopolitical events (e.g., drastic jumps in transport costs), we will inform you immediately. If no agreement is reached on the corrected price, the order will be canceled and any payments already made will be refunded immediately.

§ 4 Prices, Payment, and Shipping Costs

(1) All prices are in Euro including the Seller’s statutory VAT plus shipping costs.

(2) The customer makes the payment to Wave-Lovers, which accepts the payment in trust for the Seller.

(3) For deliveries outside the EU, additional customs duties or import taxes may apply, which are to be borne by the customer.

§ 5 Delivery and Transfer of Risk

(1) Delivery is carried out via direct shipping by the Seller. Stated delivery times are non-binding estimates.

(2) Partial deliveries are permitted, provided they are reasonable for the customer.

(3) For consumers, the risk of accidental destruction or deterioration of the goods only passes to the customer upon handover of the goods.

§ 6 Invoicing

(1) The final invoice to the customer is issued exclusively by the Seller.

(2) Wave-Lovers forwards this invoice to the customer on behalf of the Seller.

(3) Proforma invoices or offer overviews from Wave-Lovers serve for preliminary information only and are not legally binding.

§ 7 Right of Withdrawal and “Withdrawal Button”

(1) Consumers are entitled to a statutory right of withdrawal. This must be exercised towards the respective Seller.

(2) For simplification, Wave-Lovers provides an electronic withdrawal function (“Withdrawal Button”). This service will be fully technically implemented by the legal deadline of June 01, 2026, at the latest.

§ 8 Transparency: Ranking and Reviews

(1) Ranking: The sorting of products is based on relevance, price, and availability. Paid placements are clearly marked as “Ad” or “Sponsored”.

(2) Reviews: We only publish reviews from customers who have actually purchased the product through us.

§ 9 Warranty and Liability

(1) Warranty claims exist towards the Seller. Wave-Lovers provides moderating support during the process.

(2) Wave-Lovers has unlimited liability for damages resulting from injury to life, body, or health. For other damages, Wave-Lovers is only liable in cases of intent or gross negligence.

§ 10 Final Provisions and Severability Clause

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of jurisdiction for disputes is the registered office of Wave-Lovers (Berlin), provided the customer is a merchant or a legal entity under public law.

(3) We are not obliged to participate in formal dispute resolution proceedings before a consumer arbitration board and generally do not participate (ODR platform: https://ec.europa.eu/consumers/odr).

(4) Severability Clause: Should individual provisions of these GTC be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected. The parties shall replace the ineffective provision with an effective one that comes closest to the economic purpose of the ineffective provision.
